Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your use of the Carbon Insights platform and services (the "Service"), operated by CarbonInsights ("we," "our," or "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Carbon Insights provides carbon-market data, analytics, forecasting, and related tools and support. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You must not misuse the Service, including infringing others' rights, uploading malicious code, scraping or circumventing security features, or using it for any unlawful purpose.

4. Intellectual Property

The Service and all its content, features, and functionality are the exclusive property of CarbonInsights and its licensors, protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent. You retain ownership of any content you submit; you grant us a worldwide, non-exclusive, royalty-free licence to use it solely to operate and provide the Service, subject to any confidentiality terms in a separate agreement.

5. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind regarding availability, reliability, or accuracy.

The Service is provided for informational purposes only and does not constitute financial, investment, or trading advice. You should not rely solely on it when making decisions, and should consult a qualified advisor.

To the fullest extent permitted by law, CarbonInsights shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

6. Privacy

We process personal data in accordance with our Privacy Policy, which forms part of these Terms.

7. Enterprise Agreements and Precedence

Where you have entered into a separate written subscription, data, or services agreement with CarbonInsights (an "Enterprise Agreement"), that agreement governs your use of the Service and prevails over these Terms to the extent of any conflict, including on term, termination, warranties, indemnity, and liability.

8. Changes, Governing Law, and Contact

We may update these Terms from time to time; material changes take effect 30 days after notice. These Terms are governed by the laws of Germany, with exclusive jurisdiction of the courts of Frankfurt am Main.
